In violation of S. L. 2003-2984 section 6.20 Transfer of Land for the Millennium Campuses of UNC Greensboro and NC A&T State University, May 2006 UNC Board of Governors (herein UNC BOG)  approved a ground lease of the land and existing improvements for alleged Joint Millennial Campus which had not been designated Pursuant NC GS 116-198.34. (8b) to the Greensboro Center for Creative development, Inc. renamed Gateway Research Park, Inc., placed on the consent a by UNC President Erskine Bowles Administration fraudulent alleging in October 2003 the Boards of Trustees of North Carolina A&T State University and The University of North Carolina at Greensboro requested, and the Board of Governors approved, the designation of the land (formerly the Central School for the Deaf) reallocated to the Board of Governors by the 2003 Session of the General Assembly and a 75-acre parcel of land currently comprising a portion of the NC A&T State University Farm as a Joint Millennial Campus.

NCAT/UNCG Joint Millennial Campus (JMC) constitute the classic tell a lie loud and long enough it becomes accepted as truth.  
Repeated association of proposed NCA&T/UNCG Joint Millennial campus (JMC) with corporation, Greensboro Center for Innovative Development, Inc, (GCID), renamed Gateway Research Park, Inc., created misconception creation of GCID established JMC.   Chancellor James C.  A Millennial Campus' as defined in the stature is real property and appurtenant facilities designated by the Board of Governors- NCGS§116-198.33.(4a). NCGS: 116-198.34. (8b) Legislation states the Board should act on the recommendation of the President after the President has consulted with the Chancellor and the Board of Trustees.  The designation should be based on the express finding that the institution has the administrative and fiscal capacity to create and maintain such a campus. (Emphasis added).

May 2006 UNC President Erskine Bowles Administration placed   Lease of Joint Millennial Campus on UNC Board of Governors (UNC BOG) consent  agenda fraudulent claiming Oct. 2003 designation of NCA&T/UNCG Joint Millennial Campus in document Lease of Joint Millennial Campus  which had not been designated pursuant NCGS§ 116-198.34.(8b),  from which lease was approved to The Greensboro Center for Innovative Development, Inc., renamed Gateway Research Park  UNC Board of Governor document Lease of Joint Millennial Campus – North Carolina A&T State University and The University of North Carolina at Greensboro  Board meeting material May 12, 2006 stated in part:

  • In October 2003, the Boards of Trustees of North Carolina A&T State University and The University of North Carolina at Greensboro requested, and the Board of Governors approved, the designation of the land (formerly the Central School for the Deaf) reallocated to the Board of Governors by the 2003 Session of the General Assembly and a 75-acre parcel of land currently comprising a portion of the NC A&T State University Farm as a Joint Millennial Campus.
  • Now, the Boards of Trustees of NC A&T and UNCG are requesting permission to execute a ground lease of the land and existing improvements for the Joint Millennial Campus to the Greensboro Center for Innovative Development, a jointly-controlled and jointly-funded 501(c)(3) entity that will administer the educational, research, and economic development mission of the Joint Millennial Campus.

University of North Carolina At Greensboro Board of Trustees February 2, 2006 Action Item: Lease Agreement between the Greensboro Center for Innovative Development and UNCG and NC A&T.  The purpose of this action is to request approval from this Board to proceed with a 50-year ground lease (and two successive 10 year renewals) with the GCID on land owned by the State of North Carolina (at the former Central North Carolina School for the Deaf and approximately 75 acres adjacent to the NCA&T farm).  In order to facilitate the GCID's ability to perform its role as manage/developer it was determined by counsel for the universities and the GCID to pursue a master lease for the properties Identified as the JMC and "not designated  JMC pursuant NCGS § 116-198.34.(8b)    GATEWAY GRND LEASE APPROVAL.pdf   Pages 10-14,   
February 2, 2006 ,University of North Carolina At Greensboro Board of Trustees Action Item: Lease Agreement between the Greensboro Center for Innovative Development and UNCG and NC A&T unambiguous state the Lease was for an Identified JMC by counsel for the universities and the GCID  and not designated by UNC Board of Governors.   Furthermore Action Item alluded to 75 acres adjacent to the NC A&T farm and not the 75-acre parcel of land currently comprising a portion of the NC A&T State University Farm as stated Board document  Lease of Joint Millennial Campus substantiating JMC had not been designated in 2003 as description would be the same in 2006 as 2003.

(Emphasis added).  Millennial Campus statue provided for the establishment of a joint campus.   NCGS: 116-198.34. (8b) provides:
  1. Acting on recommendation made by the President of The University of North Carolina after consultation by the President with the Chancellor and the Board of Trustees of a constituent institution, , to designate real property held by, or to  be acquired by, a constituent institution as a "Millennial Campus" of the institution.
  2. That designation shall be based on an express finding by the Board of Governors that the institution desiring to create a "Millennial Campus" has the administrative and fiscal capability to create and maintain such a campus and provided further,
  3. that the Board of Governors has found that the creation of the constituent institution's "Millennial Campus" will enhance the institution's research, teaching, and service missions as well as enhance the economic development of the region served by the institution.
Upon formal request by the constituent institutions, the Board of Governors may authorize two or more constituent institutions which meet the requirements of this section to create a joint Millennial Campus.
 
Record request to UNC BOG/ UNC GA for substance of NC GS § 116-198.34.(8b) statutory requirements to establish NCA&T/UNCG Joint Millennial Campus (JMI), and  lease, which included Board authorization establishing the Joint Millennial Campus, Consultations and recommendations establishing the Joint Millennial Campus, and authorization transferring the School for the Deaf property to the Joint Millennial Campus, etc.  Request reply ” we have provided hundreds of pages of documents related to the establishment of the joint campus and joint school. If the requested documents exist, they would be included in the documents we’ve already provided, since I’ve given you everything we have.” Indeed, Initial records request produce "580 pages of correspondence and associated documents requested between UNC-General Administration and NC A&T, UNCG, and Gateway collected from multiple divisions in this office and covers several years" .  Addition document were request to clarify initial received documents from the GA, UNCG, and NC A&T.  Notwithstanding volumes of documents NC GS § 116-198.34.(8b)  statutory requirements to establish Joint Millennial Campus (JMI), its lease, including a copy Board authorization establishing the Joint Millennial Campus  were not received.
 
After  response "I've given you all we have pursuant record requests for statutory requirement for NC GS NC GS § 116-198.34.(8b)  from Public records contact Ms. Joi Washington VP Communication UNC BOG /UNC GA , UNC GA Thomas Ross administration began to place fraudulent minutes on the BOG website at www.northcarolina.edu for Oct. 2003, alleged designation date for example Appendix_ G_-_Joint_Millennial_Campus in substance says:
 
NCGS 116-198.34. (8b) provides:  upon formal request by constituent institutions, the Board of Governors may authorize two or more constituent institutions which meet the requirements of this section to create a joint Millennial Campus

NC A&T and UNCG Board of Trustees Resolutions dated Aug. 22, 2003 and Aug. 28, 2003 call for designation of  Joint Millennial Campus in terms of the Central North Carolina School of the Deaf transferred to UNC Board of

Governors for the purpose of establishing a Joint Millennial Campus and nonprofit corporation be the entity be designated to accept School for the Deaf without a syllable pertaining to a parcel of land currently comprising a portion of NC A&T farmland statutory foreclosing NC A&T/UNCG Joint Millennial Campus in terms of “designation of the land (formerly the Central School for the Deaf) reallocated to the Board of Governors by the 2003 Session of the General Assembly and a 75-acre parcel of land currently comprising a portion of the NC A&T State University Farm as a Joint Millennial Campus.” as stated in  Appendix_ G_-_Joint_Millennial_Campus and Lease of Joint Millennial Campus document.   Furthermore,  if UNC BOG had acted pursuant universities Boards of Trustees resolutions which call for nonprofit (Greensboro Center for Innovative Development) be the entity designated to accept transfer of the North Carolina School for the Deaf  a lease of designated JMC would not have been required as it would have been the entity designated to accept the transfer.
 
NC GS 116-198.34. (8b) required an express finding by the Board of Governors that the institution desiring to create a "Millennial Campus" has the administrative and fiscal capability to create and maintain such a campus and administrative.  Board document Appendix_G_-_Joint_Millennial_Campus  says  campuses have administrative and fiscal capability required.
Although BOG allegedly determined campuses had the administrative and physical capacity required Universities Board of Trustees Resolutions called for establishment of nonprofit to manage JMC and  designated to accept transfer of former school of the Deaf property from UNC BOG.  Alleged universities request to establish JMC a no-letter head document, received from UNCG,  state " request ...represent no financial risks or obligations to either N.C. A&T or The University of North at Greensboro.  Unambiguous statement "request ...represent no financial risks or obligations to either N.C. A&T or The University of North at Greensboro" in conjunction with  resolutions calling for establishing nonprofit to manage Joint Millennial Campus and be entity to accept transfer of North Carolina School of the Deaf  are dispositive, unsupportive of  statutory requirements , and a Board determination campuses had administrative and fiscal capability required  universities  to create and maintain such a campus in light universities anticipated no financial obligations and nonprofit was to be established to handle management.
For example,  BOG used of taxpayer money to fund  alleged Joint Millennial Campus when when Chapter 116 Article 21B The Centennial Campus, the Horace Williams Campus, and the Millennial Campuses Financing Act requires no pledge of taxes or the faith and credit of the State or any agency or political subdivision thereof, to pay the cost, in whole or part, of buildings, structures, or other facilities for the Centennial Campus, located at ... any Millennial Campus as defined by G.S. 116 198.33(4b) is dispositive to BOG determination campuses had fiscal capacity required less than six month after alleged Oct. 2003 designation, see

Examining the Board of Governors alleged NCA&T/UNCG Joint Millennial Campus designation by local newspaper Greensboro News and Record whose coverage of the Joint Millennial Campus and Joint School of Nanoscience and Nanotechnology may qualify the paper as  mouthpiece of both, printed:

Language  "announced plans" and "will complement the proposed Millennial Campus being planned  referred to NCAT/UNCG Joint Millennial Campus in the November 27, 2003  Counting Our Blessings and Median Planting Lead to Gateway Garden- May 30, 2004 as reported in the paper (Greensboro News and Record) contradict Lease of Joint Millennial Campus statement JMC was designated Oct. 2003.
