 NCAT/UNCG Joint Millennial Campus (JMC) constitute the classic tell a lie loud and long enough it becomes accepted as truth. Repeated association of proposed NCA&T/UNCG Joint Millennial campus (JMC) with corporation, Greensboro Center for Innovative Development, Inc, (GCID), renamed Gateway Research Park, Inc., created misconception creation of GCID established JMC.  Bleeding out taxpayers,  alleged Gateway Research Park (JMC) maybe become the icon for Occupy Raleigh Movement. The Millennial Campuses Financing Act. NCGS § 116-198.31 dictates no pledge of taxes or the faith and credit of the State or any agency or political subdivision thereof, to pay the cost, in whole or part, of buildings, structures, or other facilities. In 2009 when an estimated 5000 teachers lost their jobs, unemployment at an all time high and food banks at an all-time low, the alleged Joint Millennial Campus received $ 49,274.294 taxpayer dollars to build a Joint
School of Nanoscience and Nanoengineering Research Building owned by private corporation Gateway Research Park. NCA&T/UNCG Joint Millennial Campus (JMC) designation by  University of North Carolina Board of Governors (UNC BOG) pursuant NCGS§ 116-198.34.(8a.)(8b) - didn’t happen.

May  2006 the Board of Governors of the University of North Carolina ( UNC-BOG) approved Lease of a alleged NC A&T/UNCG Joint Millennial campus which had not been designated Pursuant NCGS 116-198.34. (8b) to private corporation  Greensboro Center for Innovative Development (GCID), later renamed Gateway Research Park, INC. defrauding the people of North Carolina  of  150 acres of  land and several  building for  50 years for a fee of  $1.
UNC Board of Governor document Lease of Joint Millennial Campus – North Carolina A&T State University and The University of North Carolina at Greensboro at www.northcarolina.edu Board meeting material May 12, 2006 says: 

·         In October 2003, the Boards of Trustees of North Carolina A&T State University and The University of North Carolina at Greensboro requested, and the Board of Governors approved, the designation of the land (formerly the Central School for the Deaf) reallocated to the Board of Governors by the 2003 Session of the General Assembly and a 75-acre parcel of land currently comprising a portion of the NC A&T State University Farm as a Joint Millennial Campus.

·         Now, the Boards of Trustees of NC A&T and UNCG are requesting permission to execute a ground lease of the land and existing improvements for the Joint Millennial Campus to the
Greensboro Center for Innovative Development, a jointly-controlled and jointly-funded 501(c)(3) entity that will administer the educational, research, and economic development mission of the Joint Millennial Campus.

·         It is recommended that the request of the Board of Trustees of North Carolina A&T State University and the Board of Trustees of The University of North Carolina at Greensboro be approved and transmitted to the Council of State for final action.  Emphasis added

·         In February 2003, the concept for a "Joint Millennial Campus was presented to the UNC Office of the President indicating the potential for collaborative opportunities between UNCG and NCA&T.  Later that year, the Joint Millennial Campus was introduced to the community.

·         In Sept. 2003, in order to create an efficient vehicle to manage the UNCG/NCAT Joint Millennial Campus (JMC), a separate 501(c)3 not-for-profit was established. The newly formed organization is known as the Greensboro Center for Innovative Development (GCID). The GCID is charged with the management and development of the properties that represent the JMC.

·         In Sept. 2005, a Management Services and Development agreement (MSDA) between the GCID and NCA&T and UNCG was approved..

Chronology provided to UNCG Board of Trustees prior to Lease vote unambiguous doesn't say  designation Oct. 2003 of Joint Millennial Campus.

 
Empowering UNC Board of Governors to establish a Millennial Campus NCGS§ 116-198.34. (8b) authorized UNC BOG to designate real property held by, or to be acquired by, a constituent institution as a millennial campus of that institution through the 2000 Millennial Campus Act.  A Millennial Campus' as defined in the stature is real property and appurtenant facilities designated by the Board of Governors. And not necessary an academic unit for example the Veterans Affairs nursing home in western part of North Carolina is located on the Millennial Campus of Western Carolina University. The Legislation states the Board should act on the recommendation of the President after the President has consulted with the Chancellor and the Board of Trustees. The designation should be based on the express finding that the institution has the administrative and fiscal capacity to create and maintain such a campus. (Emphasis added)  Upon formal request by the constituent institutions, the Board of Governors may authorize two or more constituent institutions which meet the requirements of this section to create a joint Millennial Campus.  NCGS: 116-198.34. (8b) provides:
  • Acting on recommendation made by the President of The University of North Carolina after consultation by the President with the Chancellor and the Board of Trustees of a constituent institution, , to designate real property held by, or to  be acquired by, a constituent institution as a "Millennial Campus" of the institution.
  • That designation shall be based on an express finding by the Board of Governors that the institution desiring to create a "Millennial Campus" has the administrative and fiscal capability to create and maintain such a campus and provided further,
  • that the Board of Governors has found that the creation of the constituent institution's "Millennial Campus" will enhance the institution's research, teaching, and service missions as well as enhance the economic development of the region served by the institution.
  • Upon formal request by the constituent institutions, the Board of Governors may authorize two or more constituent institutions which meet the requirements of this section to create a joint Millennial Campus.
 
Document allege Joint Millennial Campus was designated Oct. 10, 2003.   NC A&T is unable to located  document  allege copy to J. Renick 10/22/03.  UNC General Administration couldn't produce a copy of document  and UNCG who originally provided  it  would not verify  document.

June 2003 NC General Assembly reallocated the former Central School of the Deaf to the UNC BOG to be used for the establishment of Millennium campuses of the University of North Carolina at Greensboro and North Carolina Agricultural and Technical State University.
NCGS 116-198.34. (8b) provides:  upon formal request by constituent institutions, the Board of Governors may authorize two or more constituent institutions which meet the requirements of this section to create a joint Millennial Campus

UNC-Greensboro Board of Trustees Resolution dated NCA&T & UNCG Boards of Trustees Resolution dated Aug. 22, 2003 and Aug. 28, 2003 call for designation of  Joint Millennial Campus in terms of the Central North Carolina School of the Deaf transferred to UNC Board of Governors for the purpose of establishing a Joint Millennial Campus and nonprofit corporation be the entity be designated to accept School for the Deaf without a syllable pertaining to a parcel of land currently comprising a portion of NC A&T farmland

Although BOG allegedly determined campuses had the administrative and physical capacity required Universities Board of Trustees Resolutions called for establishment of nonprofit to manage JMC and  designated to accept transfer of former school of the Deaf property from UNC BOG is dispositive to BOG alleged determined campuses had  administrative capacity required.
BOG use of taxpayer money to fund  alleged Joint Millennial Campus when when Chapter 116 Article 21B The Centennial Campus, the Horace Williams Campus, and the Millennial Campuses Financing Act requires no pledge of taxes or the faith and credit of the State or any agency or political subdivision thereof, to pay the cost, in whole or part, of buildings, structures, or other facilities for the Centennial Campus, located at ... any Millennial Campus as defined by G.S. 116 198.33(4b) is dispositive to BOG determination campuses had fiscal capacity required less than six month after alleged Oct. 2003 designation, see
 

When Lease was approved Greensboro Attorney Jim W. Phillips, Jr. and current BOG Chairwomen Hannah Gage are former and current UNC-BOG members cited in Controversy Surrounds UNC Board of Governors Selections, Violations of state law occur in House, Senate nomination process , which said “The system of legislative selection we now have seems likely to fill the BOG with political supporters of the legislative leaders”. NCGS 116-6:  Election and terms of member of Board of governors (C) “…each house shall hold their elections within 30 legislative days after appointments to their education committees are complete.”  The corrected House Calendar (89th legislative Day) was Wednesday, June 29, 2005. House Resolution 1788 (adopted 6/30/05) stated:

  • A House Resolution electing Bradley Adcock, Dudley flood, Frank Grainger, Charles Mercer, Jr. Craig Souza, Fred Mills, Irvin Roseman, David Young, and Charles Hayes to the Board of Governor of the University of North Carolina.
  • Section 1. The following persons are elected to the Board of Governors of the University of North Carolina for a term commencing July 1, 2005, and ending June 30, 2007.

The downstream impact of the House election of Board of  Governors on June 30th   may have constituted an illegal board and potential nullify board actions Lease of (alleged) Joint Millennial Campus - May 2006 and authorization of Joint School of Nanoscience and Nanoengineering - May 2007  taking place during the period of their appoints, such as  lease of alleged Joint Millennial Campus to Gateway Research Park and authorization of  JSNN in a legal setting.
