In violation of S. L. 2003-2984 section 6.20 Transfer of Land for the Millennium Campuses of UNC Greensboro and NC A&T State University, May 2006 UNC Board of Governors (herein UNC BOG)  approved ground lease of the land and existing improvements for alleged Joint Millennial Campus which had not been designated Pursuant NC GS 116-198.34. (8b) to the Greensboro Center for Creative development, Inc. renamed Gateway Research Park, Inc., placed on the consent agenda by UNC President Erskine Bowles Administration fraudulent alleging in October 2003 the Boards of Trustees of North Carolina A&T State University and The University of North Carolina at Greensboro requested, and the Board of Governors approved, the designation of the land (formerly the Central School for the Deaf) reallocated to the Board of Governors by the 2003 Session of the General Assembly and a 75-acre parcel of land currently comprising a portion of the NC A&T State University Farm as a Joint Millennial Campus which UNC BOG has never designated.    
February 2, 2006 Action Item: Lease Agreement between the Greensboro Center for Innovative Development and UNCG and NC A&T before UNCG Board of Trustees unambiguous pertained to Identified JMC  by GCID, Universities Counsel, and Office of UNC President Bowles  consisting former Central NC School for the Deaf and approximately 75 acres adjacent to NC A&T farm  - N0T an UNC BOG NC GS 116-198.34. (8b)  designated JMC.  see  GATEWAY GRND LEASE APPROVAL.pdf   Pages 10-14,   Furthermore Action Item alluded to 75 acres adjacent to the NC A&T farm and not the 75-acre parcel of land currently comprising a portion of the NC A&T State University Farm as stated in Board document  Lease of Joint Millennial Campus substantiating JMC had not been designated in 2003 as description of JMC would be the same in Lease 2006 as in  alleged 2003 designation.  Action Item Chronology indicated JMC was never designated nor was Lease of existing improvements as stated in Appendix_G_-_Joint_Millennial_Campus before UNCG Board of Trustees.
         NC GS 116-198.34. (8b) provides:  upon formal request by constituent institutions, the Board of Governors may authorize two or more constituent institutions which meet the requirements of this section to create a Joint Millennial Campus.    NC A&T and UNCG Board of Trustees Resolutions dated , Aug. 22 2003 and Aug. 28, 2003 call for designation of  Joint Millennial Campus in terms of the Central North Carolina School of the Deaf transferred to UNC Board of Governors for the purpose of establishing a Joint Millennial Campus and nonprofit corporation be the entity be designated to accept School for the Deaf without a syllable pertaining to a parcel of land currently comprising a portion of NC A&T farmland statutory foreclosing NC A&T/UNCG Joint Millennial Campus in terms of “designation of the land (formerly the Central School for the Deaf) reallocated to the Board of Governors by the 2003 Session of the General Assembly and a 75-acre parcel of land currently comprising a portion of the NC A&T State University Farm as a Joint Millennial Campus.” as stated in  Appendix_ G_-_Joint_Millennial_Campus and Lease of Joint Millennial Campus document.   Furthermore,  if UNC BOG had acted pursuant universities Boards of Trustees resolutions which call for nonprofit (Greensboro Center for Innovative Development) be the entity designated to accept transfer of the North Carolina School for the Deaf  a lease of designated JMC would not have been required.
"Millennial Campus" Statue NC GS 116-198.34. (8b) states " designation shall be based on an express finding by the Board of Governors that the institution desiring to create a "Millennial Campus" has the administrative and fiscal capability to create and maintain such a campus".  University Boards of Trustees resolutions  called for  establishment of of nonprofit to manage Joint Millennial Campus and alleged letter headless document received pursuant record request  on page 2  says "represents no financial risks or obligations to either N.C. A&T State University or The University of North Carolina at Greensboro  clearly communicate the universities plan neither to manage or financial support requested Joint Millennial, unambiguous unsupportive an express finding they intended to physical support or administrate a JMC.
For example,  BOG used of taxpayer money to fund  alleged Joint Millennial Campus when when Chapter 116 Article 21B The Centennial Campus, the Horace Williams Campus, and the Millennial Campuses Financing Act requires no pledge of taxes or the faith and credit of the State or any agency or political subdivision thereof, to pay the cost, in whole or part, of buildings, structures, or other facilities for the Centennial Campus, located at ... any Millennial Campus as defined by G.S. 116 198.33(4b) is dispositive to BOG determination campuses had fiscal capacity required less than six month after alleged Oct. 2003 designation taxpayer money is allocated to pay the telephone bill, etc

JMC was Never Designated

A Millennial Campus' as defined in the stature is real property and appurtenant facilities designated by the Board of Governors. The Legislation states the Board should act on the recommendation of the President after the President has consulted with the Chancellor and the Board of Trustees.  The designation should be based on the express finding that the institution has the administrative and fiscal capacity to create and maintain such a campus. (Emphasis added).
 Millennial Campus statue provided for the establishment of a joint campus.   NCGS: 116-198.34. (8b) provides:
  1. Acting on recommendation made by the President of The University of North Carolina after consultation by the President with the Chancellor and the Board of Trustees of a constituent institution, , to designate real property held by, or to  be acquired by, a constituent institution as a "Millennial Campus" of the institution.
  2. That designation shall be based on an express finding by the Board of Governors that the institution desiring to create a "Millennial Campus" has the administrative and fiscal capability to create and maintain such a campus and provided further,
  3. that the Board of Governors has found that the creation of the constituent institution's "Millennial Campus" will enhance the institution's research, teaching, and service missions as well as enhance the economic development of the region served by the institution.
Upon formal request by the constituent institutions, the Board of Governors may authorize two or more constituent institution.

Record requests to UNC BOG/UNC GA for the substance of statutory requirements to establish NCA&T/UNCG Joint Millennial Campus (JMC), and its lease was:

1.      Board authorization designation (NC A&T & UNCG) Joint Millennial Campus.

2.      consultations and recommendations pertaining to designating Joint Millennial   Campus   (JMC).

3.      documents the basis for determination campuses had administrative and fiscal capacity required to establish JMC.

4.      President recommendation to the Board of Governors pertaining to JMC.

5.      NCA&T/UNCG Request to establish JMC.

6.      NCA&T/UNCG Request to Lease JMC to Greensboro Center for innovative Development.

Request reply ” we have provided hundreds of pages of documents related to the establishment of the joint campus and joint school. If the requested documents exist, they would be included in the documents we’ve already provided, since I’ve given you everything we have.” Indeed, Initial records request produce "580 pages of correspondence and associated documents requested between UNC-General Administration and NC A&T, UNCG, and Gateway collected from multiple divisions in this office and covers several years" . Addition document were request to clarify initial received documents from the GA, UNCG, and NC A&T.   Notwithstanding volumes of documents NC GS § 116-198.34.(8b) statutory requirements to establish Joint Millennial Campus (JMC), its lease, including a copy Board authorization establishing the Joint Millennial Campus were not received.
